Bizarre personal injury photos


The woman in these photos suffered a bizarre personal injury; the photographs were taken for a newspaper and used as a human interest story.

So they are very different from the usual kind of personal injury photographs, the kind which are taken for a lawyer or solicitor to support a personal injury claim.

It’s pretty unusual to take pictures of a personal injury victim for a newspaper. It’s also pretty risky because it could have endangered the victim’s case if she made a personal injury claim and if it were judged in a court.

Did she have sufficient grounds to pursue a personal injury claim against the operator of the park for negligence?
On the one hand the operator had a duty to ensure that the park was safe, but the steel rod was pretty rusty and the park cleaners could have mistaken it for a small branch.
If she pursued a claim in court the judge would have to decide whether the park operator had taken all reasonable precautions to ensure the woman’s safety.
The judge would also have to decide whether the woman had taken all reasonable precautions to ensure her own safety.
It was a hot day and she was wearing sandals which provided no protection for her feet.
Is this reasonable?
